Senate Democrats are accusing Social Security Commissioner Frank Bisignano of using agency communications to spread partisan rhetoric and inaccurate tax claims to millions of older Americans.
In a July 21 letter to Bisignano, five lawmakers alleged that a mass email distributed to retirees earlier this month contained a “gross overestimate” of recent federal tax relief and breached the official’s pledge to maintain the agency’s political neutrality.
The controversy stems from a July 2 message titled “Making Life More Affordable for America’s Seniors.” The email praised administrative improvements, such as reduced wait times at field offices, before attributing billions in financial relief to President Donald Trump and the Republicans’ One Big Beautiful Bill Act, or OBBBA.
“Thanks to President Trump, over 35 million American seniors received an average of $7,500 in relief this tax season,” Bisignano wrote in the message, concluding with the assertion that “America’s seniors are winning!”
However, some tax experts and advocacy groups warn that the commissioner’s narrative presents a distorted picture of how the tax code operates.
Though the administration previously claimed the OBBBA would eliminate federal income taxes on Social Security benefits, the actual legislation established a temporary $6,000 tax deduction for filers 65 and older. Since a tax deduction only reduces how much income gets taxed, rather than cutting a tax bill dollar-for-dollar, most older Americans will save far less than the email suggested.
Analysis from the Tax Policy Center shows older Americans received an average tax reduction of roughly $1,100 under the senior deduction, according to Max Richtman, president and CEO of the National Committee to Preserve Social Security and Medicare.
“The OBBBA did not reduce or eliminate taxes on Social Security benefits,” Richtman said in an email to CBS News. “[Mr.] Trump and Bisignano are misleading the public by claiming otherwise.”
A report from the Center on Budget and Policy Priorities shows that nearly half of older Americans do not owe federal income taxes in the first place, making the deduction useless for them. Meanwhile, Treasury Department data shows that filers earning between $50,000 and $100,000 saved an average of roughly $815, while those making between $100,000 and $200,000 saved around $1,250.
Shannon Benton, executive director of The Senior Citizens League, told the publication that while the $7,500 figure might reflect the average gross size of claimed deductions across households, “it wasn’t a $7,500 tax refund or $7,500 in direct savings.”
Apart from the tax numbers, the lawmakers targeted the commissioner’s use of government resources to promote administration policies. In their letter, Sens. Elizabeth Warren, Ron Wyden, Tammy Baldwin, Sheldon Whitehouse and Ben Ray Luján argued that the commissioner violated commitments made during his March 2025 confirmation hearing.
“You have once again disregarded your promise to ‘run the SSA in an independent and nonpartisan manner’ and instead are wasting taxpayer resources while threatening the credibility and trustworthiness of the Social Security program,” the senators wrote.
Advocacy groups backed the senators’ complaints, calling the communication an unprecedented break from agency norms. Nancy Altman, president of Social Security Works, told CBS News that using official channels for political messaging was “highly inappropriate.”
The Democratic senators have set an August 11 deadline for Bisignano to respond to inquiries regarding the email’s production and distribution.
