A Pennsylvania man has been charged with murder after he allegedly shot and killed his wife in a car after she “disrespected him in front of others” at a party.
Jose Antonio Luna, 59, was arrested soon after the shooting Saturday evening in Rockledge, a suburb of Philadelphia, the Philadelphia Inquirer reported.
Luna allegedly shot his wife, 48-year-old Alisett Schubert, multiple times inside her silver Nissan Murano, ultimately killing her, 6ABC reported.
The married couple had been arguing as they drove home that night when Schubert, who was behind the wheel, told Luna to get out of the car and walk home, according to court documents obtained by the Inquirer.
They then began to wrestle over Schubert’s purse, where she kept a .38 caliber revolver that was registered in her name, according to the affidavit.
Luna got hold of the weapon and shot his wife once, prompting her to yell, “Oh my God,” and try to run away. Luna then shot her four more times, according to court documents.
The accused later told investigators that Schubert had “disrespected him in front of others” during the party they were at earlier.
A Southeastern Pennsylvania Transportation Authority (SEPTA) bus driver came across the couple’s car stalled in the road — and then heard two or three gunshots. The bus driver watched Luna exit the car and open the driver’s side door, and said Schubert’s body “slouched” out of the car, according to the affidavit.
The bus driver then watched Luna then fled the scene. When police later caught him about a mile away, Luna put Schubert’s gun to his head and pulled the trigger, but the gun was out of ammunition and did not go off, according to the affidavit.
Luna was arrested without incident.
After police located Schubert, she was taken to a nearby hospital suffering from multiple gunshot wounds. She was pronounced dead at the hospital.
According to the affidavit, Schubert had previously told a close friend that Luna was physically and mentally abusing her.
Prosecutors also said that Luna had an extensive criminal history and had been arrested “numerous” times for illegal entry into the U.S. and for reentry after deportation. The Independent has contacted the Montgomery County District Attorney’s Office for more information.
In addition to first-degree murder, Luna was charged with third-degree murder and possessing an instrument of a crime.
He is being held without bail at the Montgomery County Correctional Facility. He is due to have a preliminary hearing March 5.
