Despite already accepting deposits for President Donald Trump’s gold-plated “T1” smartphone, originally expected to launch in August 2025 but now delayed multiple times, updated preorder terms now make it clear there is no guarantee the device will ever be released.

“A preorder deposit provides only a conditional opportunity if Trump Mobile later elects, in its sole discretion, to offer the Device for sale,” Trump Mobile, co-founded by Donald Trump Jr. and Eric Trump, says on its preorder terms page about the $100 deposit.

“A deposit is not a purchase, does not constitute acceptance of an order, does not create a contract for sale, does not transfer ownership or title interest, does not allocate or reserve specific inventory, and does not guarantee that a Device will be produced or made available for purchase,” it continues.

The fine print adds that the $100 deposit is nonbinding and does not reserve a phone, secure the $499 promotional price, or guarantee any features, specs, release date or inventory, despite the website urging customers in the lefthand cormer to “lock in” the deal.

“The deposit does not lock in pricing, promotions, service plans, taxes, fees, shipping costs or other commercial terms. Final pricing and offers will be disclosed at the time of purchase, and you will have the opportunity to accept or reject the final terms before completing your purchase. Pricing and promotional terms may change any time prior to purchase,” the site states.

“Any applicable taxes will be calculated at the time of final sale and may vary based on shipping location and then-current tax laws. Any prior advertising, marketing materials, product renderings, feature descriptions, or estimated timelines are informational only and do not constitute binding representations, warranties or guarantees,” the website reads.

Instead, Trump Mobile says the final price will only be confirmed later, at the time of purchase. At that point, customers would be able to decide whether to proceed with the sale or walk away, and even then, pricing and promotional terms could still change before checkout.

The Independent has contacted Trump Mobile and The Trump Organization for comment.

The T1 Phone was first unveiled as the flagship device for Trump Mobile, with an initial expected launch date of August 2025. However, uncertainty remains about demand and production. One estimate cited by the International Business Times suggested as many as 600,000 people may have placed deposits.

Even if the phone does move forward, the company outlines multiple conditions that must be met before a sale is finalized.

“(1) Trump Mobile makes the Device available for sale; (2) you complete checkout; (3) you submit full payment; and (4) Trump Mobile accepts and successfully processes payment. Until those conditions are satisfied, no enforceable agreement for purchase exists, “ the website states.

The shifting terms come amid ongoing controversy and repeated delays surrounding the Trump-branded phone. Last month, Trump Mobile unveiled a redesigned “T1” with a more conventional vertical camera layout, replacing the original triangular design.

“Made in the USA” claims have since been walked back, with broader language now claiming the T1 is “designed with American values” and supported by “American teams.”

In January, a group of Democratic senators led by Elizabeth Warren urged the Federal Trade Commission to investigate Trump Mobile over concerns about potentially misleading marketing tied to prepaid deposits and questions about whether the phone is actually made in the U.S.
