Brazilian police have seized the phone of a glamorous social worker who accused former Chelsea defender David Luiz of threatening her after she declined to have a threesome with him.

Cops acting on a court order confiscated the mobile after the 38-year-old footballer, now playing for Serie A side Fortaleza, sued Francisca Karollainy Barbosa Cavalcante for defamation and slander.

The pretty brunette’s lawyer Fabiano Tavora said overnight: ‘Karollainy voluntarily handed over her phone for forensic examination at a police station in Fortaleza.’

He told Brazilian press: ‘If there was a court order to search and seize the phone, it was made without hearing the other party.

‘In any case I’m not surprised by judicial or extrajudicial measures David Luiz may take to put an end to this case.’

The latest development in the extraordinary legal tussle came as it was confirmed the former Blues centre-back had begun legal proceedings against his 26-year-old accuser.

Miss Cavalcante reported Luiz to police last month saying she had received threatening messages from the soccer star after their alleged affair came to an end, prompting a court to issue a restraining order against him.

She claimed she had rejected an invitation from him to take part in a threesome which led to a heated dispute.

The Brazil international, currently engaged to long-time girlfriend Bruna Loureiro, was accused of warning about his ‘money and power’.

Screenshots allegedly sent by the footballer also show one message warning her that her son could ‘pay the consequences’.

A third threat is alleged to have stated: ‘I can simply make you disappear.’

Miss Cavalcante also said Luiz, who according to local media reports first met the social worker after he contacted her online and invited her to stay at a hotel in Fortaleza, offered her POUNDS 14,000 after she came forward with the allegations.

The former Chelsea defender, who also played for Arsenal for two seasons, said in an official statement after the allegations first came to light he had never met his accuser, although he admitted to a brief exchange of messages with her.

Insisting there was no record of their reported stay at the Magna Praia Hotel in Fortaleza, he added: ‘David Luiz reaffirms his commitment to the truth and trusts the facts will be duly clarified.’

The footballer’s lawyer confirmed overnight he had requested the seizure of Karollainy’s mobile phone on his client’s behalf but said he couldn’t make any further comment because of a judicial secrecy order.

Police, appearing to contradict the social worker’s claims she had handed the phone in at a police station voluntarily, said they had confiscated it during a search of her home.
