Decision:
That the making of the
Regulations to create the Devon and Torbay Combined County
Authority on the basis that they implement and give effect to the
proposal submitted to Government on 1 May 2024 by Torbay Council
and Devon County Council be approved.
Reasons for the decision:
To give effect to the
decision of the Council on 30 April 2024.
Alternative options considered:
An alternative option
would be not to consent to the Regulations. If this option were to
be adopted, then there would be no guarantee that a DT CCA and
associated devolution deal with the potential associated powers and
funding would be available to the area in the same way in the
future.

At its meeting on 30
April 2024, the Council approved the final proposal for the Devon
and Torbay Combined County Authority (DT CCA) for submission to the
then Secretary of State for Levelling Up, Housing and
Communities.
The final proposal for
the DT CCA was submitted jointly by Torbay Council and Devon County
Council on 1 May 2024.
The DT CCA will be a
“body corporate” that will be brought into being
through the Devon and Torbay Combined County Authority Regulations
2024. The Regulations will establish the DT CCA and give effect to
the Devon and Torbay devolution deal. The Regulations include the
DT CCA’s governance arrangements and the functions that it
will exercise.
The Minister of State
for Local Government and English Devolution wrote to the Leaders of
Torbay Council and Devon County Council on 17 September 2024 to
confirm the Government’s intention to finalise the necessary
Regulations to provide for the establishment, including governance
arrangements, of the DT CCA.
The Government will
lay the Regulations before Parliament subject to the consent of
Torbay Council and Devon County Council.
At its meeting on 30
April 2024 the Council also gave delegated authority to the Chief
Executive, in consultation with the Leader of the Council, to
consent to the making of the Regulations to create the DT CCA.
The Chief Executive
has consulted the Leader of the Council and is satisfied that the
Regulations implement and give effect to the proposal for the DT
CCA.
